SUBMIT YOUR PHOTO OR VIDEO: Post or repost your original photo/video to Instagram using the #PPSpontaneity hashtag, and tag @passionpassport and @hoteltonight (you cannot retag an old post). WRITE YOUR CAPTION: Tell us about one of your most spontaneous travel memories in the caption and share what new spontaneous adventure you would go on if you were to win.

Participants are limited to one (1) entry per person per day during the challenge period.
ELIGIBILITY:
Participation is open only to legal residents of the fifty (50) United States and the District of Columbia, who are at least eighteen (18) years of age and the age of majority in their state of residence. You are not authorized to participate in the Challenge if you are not located within the 50 United States or the District of Columbia. HotelTonight employees, their family members, and those living in the same household will be prohibited from entering the challenge.
PRIZE:
Three (3) winners will receive HotelTonight credits in the amounts of $2500 (first prize), $1500 (second prize), and $1000 (third prize). Approximate retail value (“ARV”) of all prizes: $5,000.
HotelTonight terms and conditions, located at https://www.hoteltonight.com/terms-of-use, apply. HotelTonight credits may only be used towards booking hotel accommodations through the HotelTonight website or mobile application and will expire within one (1) year of issuance. Winners must download the HotelTonight app (which is free) and have a HotelTonight account in order to redeem their HotelTonight credits.
WINNERS ARE RESPONSIBLE FOR BOOKING THEIR OWN TRAVEL AND ARRANGING THEIR OWN HOTEL ACCOMMODATIONS IN CONNECTION WITH USE OF THEIR HOTELTONIGHT CREDITS. GENERAL:
• This challenge is void outside of the 50 United States, the District of Columbia, and where prohibited or restricted by law.
• Internet entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an internet access provider, on-line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
• Passion Passport & HotelTonight reserve the right at their sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Challenge or the Passion Passport and/or HotelTonight website; violates the Official Rules, or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY ANY PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CHALLENGE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PASSION PASSPORT & HOTELTONIGHT RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Passion Passport and HotelTonight and its agencies are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Challenge which may limit the ability to participate or by any human error which may occur in the processing of the entries in this Challenge. Passion Passport & HotelTonight reserve the right to modify or cancel the Challenge if it becomes technically corrupted. In such event, Passion Passport & HotelTonight would award prizes by random drawing from eligible entries received prior to cancellation.
• Passion Passport will select an independent, non-biased panel of at least three (3) guest judges to rate the entries. The judges will be provided a scoring sheet in order to rate the entries based on the following equally–weighted judging criteria: quality of image, quality of the caption, and compliance with Challenge instructions. The three participants with the highest cumulative scores will be selected as the first place, second place, and third place winners. In the event of a tie, the judges are asked to rescore the entries between the tied participants. By entering the Challenge, participants fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the Challenge.
• Each potential winner will be notified by a direct message and/or by Sponsor posting a comment to the potential winner’s entry on the potential winner’s Instagram account on or about November 21, 2019. Each potential winner will be required to sign and return via overnight UPS and/or email, the Affidavit of Eligibility (“Affidavit”) and the Liability Release and, except where prohibited, Publicity Release (“Release”) forms provided by HotelTonight, within fourteen (14) days of receipt in order to receive a prize. If a potential winner fails to return the Affidavit and the Release within fourteen (14) days or if a winner is deemed to be ineligible, the prize will be forfeited and an alternate winner may be selected from among all eligible entries timely received, if time permits. If a potential winner is not reachable at the e-mail or mail address provided to HotelTonight and a forwarding address is not provided or if a Notification is returned as undeliverable, then the prize will be forfeited and an alternate winner may be selected.
• The Prize is provided “as is” and without any warranty, representation or guarantee, express or implied in fact or in law, and any implied warranty of merchantability or fitness for a particular purpose. No cash redemption or prize substitutions are allowed. Passion Passport & HotelTonight reserve the right to substitute the prize of equal or greater value in the discretion of HotelTonight. Passion Passport & HotelTonight shall have no responsibility or obligation to a winner who is ineligible for a prize, or is unable to or who does not accept or utilize a prize, for any reason. The winner is responsible for any and all taxes, fees, security and passenger facility charges applicable to the prize, which may not be issued without payment for taxes & fees.
• All travel arrangements must be booked through HotelTonight in compliance with instructions given to the winners. Winners are responsible for the cost of visa(s), passport(s), and transportation to and from the specified departure airport, meals, and other travel expenses unless stated otherwise. Prizes are non-extendable, non-transferable and non-cashable.
• PUBLICITY RELEASE: Subject to applicable law, each winner irrevocably grants Passion Passport & HotelTonight the right to use the winner’s name, voice, photograph and/or biographical data for advertising, promotional and/or publicity purposes, worldwide in perpetuity, in all forms of media, including Social media, and the Passion Passport’s & HotelTonight’s website, without any obligation or consideration except for the awarding of the prize to the winner.
• PRIVACY: Information submitted in connection with the Challenge will be treated in accordance with these Official Rules and the Privacy Policy of HotelTonight. Click here to review.
• RELEASE OF LIABILITY: By entering the Challenge, each entrant agrees that HotelTonight, Instagram, and their parent, affiliates, subsidiaries, advertising and promotion agencies and media including social media (“Challenge Entities”), and their respective shareholders, members, directors, officers, employees, and agents, will have no liability whatsoever for and are released and held harmless from any injury, loss or damages of any kind to persons, including death, personal injury, or property damage, due in whole or in part, directly or indirectly, from the acceptance, possession, use, non-use or misuse of a prize or participation in this Challenge or participation in any Challenge or prize-related activity.
